Privacy Policy

1. GENERAL PROVISIONS

This document sets out the rules for processing personal data obtained from Customers by the realb2b.eu Online Store, operated at realb2b.eu by Realne Ceny Krzysztof Alchimionek. It also contains information regarding the use of Cookies and analytical tools in the Online Store.

The controller of personal data is Realne Ceny Krzysztof Alchimionek, VAT ID (NIP): 6912433269, REGON: 022166829, ul. Bagienna 1, 59-220 Legnica, Poland (hereinafter referred to as the “Controller”).

Personal data collected by Realne Ceny Krzysztof Alchimionek through the Online Store is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), hereinafter referred to as the GDPR.

The realb2b.eu Online Store informs that Customers’ personal data will be processed solely for the purpose of performing and fulfilling the agreement concluded with the Buyer/Customer. Subject to additional consent, personal data may also be processed for the purpose of providing informational materials and marketing offers in the form of a Newsletter.

The realb2b.eu Online Store makes every effort to ensure respect for your privacy and protection of the personal information provided while using and making purchases through the Store, including, among other things, the use of a secure SSL encryption protocol.

Providing personal data is voluntary; however, failure to provide data marked as necessary will make registration or placing an Order impossible.

2. TYPES, PURPOSES AND LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

Within the realb2b.eu Online Store, personal data is collected in the following cases:

- for the purpose of performing a sales agreement concluded with the Customer for goods purchased in the Store, related to Account registration and placing Orders – the legal basis for processing is Article 6(1)(b) GDPR (performance of a contract),

- for the purpose of establishing, pursuing or enforcing claims – the legal basis is Article 6(1)(f) GDPR.

In such cases, the necessary scope of processed data includes: first name and surname; e-mail address; contact telephone number; address: street, house number, apartment number, postal code, city, country, residential/business/registered office address; bank account number (in the case of refunds), and in the case of Customers who are not consumers, additionally the company name and tax identification number (VAT ID / NIP), as well as other data collected during the use of the Online Store.

- in the case of subscription to the informational bulletin (Newsletter), for the purpose of performing a contract for the provision of electronic services. The legal basis is the consent of the Customer to the performance of the Newsletter service agreement (Article 6(1)(a) GDPR).

In this case, the necessary scope of processed data includes the e-mail address and contact telephone number.

3. DISCLOSURE OF PERSONAL DATA

For the proper functioning of the Online Store, it is necessary for the Controller to use the services of external entities. The Controller ensures that it only uses the services of entities processing data in a lawful manner, in accordance with applicable regulations, including the GDPR.

The Controller transfers data only when it is necessary for the implementation of the purpose of processing and only to the extent necessary for that purpose.

Customers’ personal data may be transferred to the following entities:

- providers of hosting and IT services,
- carriers performing Order deliveries (listed in the Store Regulations),
- entities handling electronic payments in the Online Store,
- entities providing accounting, legal and advisory services.

4. PERSONAL DATA RETENTION PERIOD

The personal data provided will be processed for the period:

- necessary for the performance of the concluded sales agreement for Goods, including the handling of the Customer’s complaints and the establishment, pursuit or defence of claims by the Controller – however, no longer than 10 years from the date the data was provided.

5. PROFILING

The realb2b.eu Online Store may use profiling functions consisting of any form of automated processing of personal data used to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning Customers’ preferences and interests.

This function allows the Controller to display advertisements tailored to the Customer’s preferences and interests and to present products that best meet the Customer’s needs. This function also enables the use of appropriate methods of communication, including the selection of the communication language.

The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning that person or similarly significantly affects that person.

6. RIGHTS OF THE DATA SUBJECT

In accordance with the GDPR, a person who provides their personal data is entitled to a number of rights, including:

- the right to information on how personal data is processed,
- the right of access to and rectification of data,
- the right to withdraw consent – legal basis: Article 7(3) GDPR,
- the right to object to the processing of personal data – legal basis: Article 21 GDPR; the Customer has the right to object at any time – on grounds relating to his or her particular situation – to the processing of his or her personal data, including profiling, where the realb2b.eu Online Store processes such data on the basis of legitimate interest,
- the right to erasure of data, the so-called “right to be forgotten” – legal basis: Article 17 GDPR,
- the right to restriction of processing – legal basis: Article 18 GDPR,
- the right to data portability – legal basis: Article 20 GDPR,
- the right to lodge a complaint with a supervisory authority.

7. COOKIES

The realb2b.eu Online Store uses Cookies. These are small text files sent by a web server and stored by the browser software on the User’s device. When the browser reconnects to the website, the site recognizes the type of device from which the User connects. The parameters allow the information contained in them to be read only by the server that created them. Cookies therefore facilitate the use of previously visited websites.

The Controller uses its own Cookies for the correct configuration of the Store, and in particular to:

- adapt the content of the Store’s websites to the Customer’s preferences and optimize the use of the websites,
- recognize the Customer’s device and its location and appropriately display the website tailored to the Customer’s individual needs,
- remember settings selected by the Customer and personalize the interface, e.g. with regard to the chosen language or region of origin,
- match appropriate advertisements to the Customer’s preferences,
- remember the history of pages visited within the service in order to recommend content,
- remember font size, website appearance, etc.

The Controller uses its own Cookies to authenticate the User in the Store and ensure the maintenance of the User’s session within the service, and in particular to:

- maintain the Customer’s Store session (after logging in), thanks to which the Customer does not need to re-enter login details and password on each subpage,
- correctly configure selected functions of the Service, in particular enabling the verification of the authenticity of the browser session,
- optimize and increase the efficiency of services provided by the Controller.

The Controller uses its own Cookies to carry out processes necessary for the full functionality of the websites, and in particular to:

- adapt the content of the Service’s websites to the User’s preferences and optimize the use of the Service’s websites. In particular, these files make it possible to recognize the basic parameters of the User’s Device and properly display the website tailored to the User’s individual needs,
- ensure the proper operation of the affiliate program, in particular enabling verification of the sources of redirections of Users to the Service’s websites.

The Controller cooperates with the following external services, which may place external Cookies:

- Google Inc., based in the USA (including Google AdSense, Google Analytics, Google Ads, Google Maps API, Google DoubleClick, Google Tag Manager, Google Search Console)

In this case, Cookies are used to enable Users to contact the Controller via the Internet using an online channel, i.e. a chat service allowing contact through the exchange of text messages,

- CallPage Sp. z o.o., based in Warsaw,
- Zendesk, Inc., based in the USA,
- Hotjar Ltd., based in Malta.

The User may independently and at any time change the settings concerning Cookies, specifying the conditions for storing and accessing Cookies on the User’s Device. Changes to these settings may be made using the settings of the web browser or service configuration. These settings may be changed in particular in such a way as to block the automatic handling of Cookies in the browser settings or to inform the User each time Cookies are placed on the User’s Device. Detailed information on the possibilities and methods of handling Cookies is available in the settings of the software (web browser).

The User may delete Cookies at any time using the functions available in the web browser they use.

Restricting the use of Cookies may affect some functionalities available on the Service’s website.

8. FINAL PROVISIONS

The Controller of the Online Store reserves the right to amend this Privacy Policy at any time and place, while undertaking to immediately publish the new Privacy Policy on the Store’s website and inform all registered Users thereof.

In matters not regulated by this Privacy Policy, generally applicable provisions of law concerning the protection of personal data shall apply.
